1. General/Applicability

These General Terms and Conditions form the basis of all deliveries and services from aperlen onlineshop to consumers. Deviating and/or supplementary agreements require the express written consent of aperlen onlineshop. A Confirmation by email is more than enough.

2. Offer

All offers from the aperlen onlineshop on the website www.aperlen.de are non-binding and subject to change. All offers are valid "as long as stocks last". Small deviations and technical changes compared to our illustrations or descriptions are possible.

By clicking the button in the final step of the ordering process, you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when aperlen onlineshop accepts your order by e-mail after receiving your order or executes the order.

3. Prices and terms of payment

The prices shown on the website of the aperlen onlineshop at the time of the order apply. All prices are final prices in euros and include the statutory value added tax of currently 7/19 percent. Obvious price errors reserved.

Packaging and shipping costs will be charged separately. aperlen onlineshop reserves the right to charge dunning costs.

All bank charges (foreign charges) for the transfer from abroad must be borne by the buyer. Receipt of payment with the deduction of bank fees is considered a partial payment and shipping can only take place after full additional payment. If you have any questions or are unclear about third-party charges, please contact your bank.

Offsetting mutual claims is only possible if your counterclaims have been legally established by a court or acknowledged in writing by aperlen onlineshop.

4. Delivery, delivery times and shipping costs

The delivery of the goods to the customer takes place exclusively via the delivery service DHL as an insured value package and Deutsche Post with proof. Pick-up is possible by arrangement. The customer chooses his preferred shipping method himself.

Shipping is to Germany, other EU countries and Switzerland. For delivery within Germany we charge a shipping fee of EUR 4.50. From a goods value of 100 EURO we take over the shipping costs within Germany for you. For deliveries to other EU countries, we charge a shipping fee of EUR 9.00. From a goods value of 150 EURO we take over the shipping costs within EU countries for you. Deliveries to Switzerland and worldwide are calculated by weight: up to 500g costs 8.00 EURO, up to 1000g costs 12.00 EURO, up to 2000g costs 24.00 EURO, up to 5000g costs 30 EURO.

Goods in stock will be dispatched within three working days. For goods that are not in stock, the delivery time can be up to four weeks after receipt of the order. For the delivery option, the a Perlen online shop is dependent on timely self-delivery. If the delivery fails for reasons for which aPERLS online shop is not responsible, aPERLS online shop can withdraw from the contract. aPERL online shop undertakes to inform the customer of this in good time. Any payments made will be refunded immediately. Partial deliveries are permitted unless the customer is clearly not interested in them or they are obviously not reasonable for him. In this case, the costs for transport and packaging will only be charged once.

5. Right of Withdrawal

You can revoke your contract declaration within one month without giving reasons in text form (e.g. letter, email) or by returning the item. The right of withdrawal does not apply to items that were only manufactured or ordered based on your wishes or specifications. The period begins at the earliest with receipt of this instruction. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline. The revocation must be sent to:

Consequences of revocation:

In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest issued). If you cannot return the service received to us in whole or in part, or only in a deteriorated condition, you may have to pay us compensation for the value. This does not apply to the surrender of items if the deterioration of the items is solely due to their inspection - as you would have been able to do in a retail shop. You can also avoid the obligation to pay compensation by not using the item as if it were your property and refraining from anything that could impair its value. Transportable items are to be sent back. You have to bear the costs of the return if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item at the time of the cancellation, you have not yet received the consideration or a contractual have made the agreed partial payment. Otherwise the return is free of charge.

6. Complaints

For all complaints such as transport damage, incorrect or missing delivery, please contact us immediately in writing by letter or e-mail to info@aperlen.de.

7. Warranty

The customer is entitled to the statutory warranty rights.

Notice:

Colored pearls and accessories can change color or stain when exposed to strong sunlight or skin contact (pH value). This does not represent a defect and is not a reason for complaint. Color reproduction may vary due to individual monitor settings. Furthermore, slight color deviations may occur due to different production processes. The illustrations of the articles on the Internet do not correspond to the original size.

aperlen onlineshop does not assume any liability for the permanent and uninterrupted availability of the online shop www.aperlen.de nor for technical or electronic errors in the online offer.

8. Reservation of proprietory rights

All deliveries are subject to retention of title. The delivered goods remain the property of the aperlen onlineshop until the purchase price has been paid in full.

9. Data Storage/Privacy and Google Analytics

10. Copyright

In particular, it is not permitted to copy, edit or publish images from the aperlen onlineshop. Violators will be prosecuted under criminal and civil law.

11. EU arbitration board

The European Commission provides a platform for online dispute resolution (OS). You can find the platform at http://ec.europa.eu/consumers/odr/.

12. Jurisdiction

Mönchengladbach is agreed as the place of jurisdiction for all disputes in connection with the delivery transaction.

With regard to all legal relationships arising from this contractual relationship, the contractual partners agree on the application of the law of the Federal Republic of Germany to the exclusion of the UN Sales Convention.

13. Additional Provision

The nullity or ineffectiveness of individual provisions of these General Terms and Conditions does not affect the validity of the remaining provisions. Void or ineffective conditions are replaced by the statutory provisions.
